Abstract :

Justice Delayed – Justice Denied is inherently associated with Indian Judicial System. More than 3.2 crores cases are pending all over the courts in India. There are many reasons for this scenario i.e. shortage of judges, shortages of courts, lack of infrastructure etc. We can say in nutshell that there is lack of Court Management in Indian Judicial System. Time consuming justice delivery is the big cause of concern in India. Looking at this state of affairs, I have proposed a unique model of National Court Management Authority (NCMA) in Indian Judicial System for proper justice delivery. NCMA will facilitate the court proceeding in effective and timely manner. Present working paper will discuss the overview of Indian Judicial System, present scenario of it, transparency & accountability in judicial system, findings of Right to Information application made in higher judiciary, various government offices and finally I have proposed a model of NCMA which will be assisted by the Court Managers appointed in accordance with the guidelines of 13th Finance Commission for Improvement in Justice Delivery in September 2010.
